President Trump has declared a national emergency involving foreign-made equipment used in America’s bulk-power system. The executive order seeks to prevent certain equipment associated with foreign governments or entities from being purchased, imported, installed, or operated when federal officials determine that it presents an unacceptable security risk.

Despite the more dramatic headlines, this isn’t a blanket ban on every transformer, turbine, or inverter with a foreign accent. The order applies to the bulk-power system—including major generating stations, control systems, substations, and transmission lines rated at 69 kilovolts or higher—not ordinary local distribution facilities. Restrictions must involve equipment connected to a “Covered Foreign Entity” and must be based on risks such as sabotage, unauthorized access, malicious remote operation, supply disruption, or catastrophic damage to critical infrastructure.

The order also addresses equipment already in service. The energy secretary may require vulnerable equipment to be identified, isolated, monitored, secured, disconnected, replaced, or removed. Before taking the more disruptive steps, however, the secretary must consider grid reliability, public safety, replacement availability, and continuity of essential service. The Department of Energy has 120 days to issue implementing rules as needed and may develop a list of prequalified equipment and vendors.

This isn’t Trump’s first visit to this particular circuit box. He issued a similar order in May 2020, although the Biden administration later suspended it and the Energy Department revoked its principal implementing prohibition before the emergency expired. That history illustrates both the persistence of the security concern and Washington’s remarkable ability to reverse course every four years while the transformers remain exactly where they were.

The Case for Checking the Wiring Before We Plug It In

Supporters begin with a point that’s difficult to dispute: the electric grid isn’t merely another industry. It’s the infrastructure beneath nearly every other piece of infrastructure.

Hospitals, water-treatment plants, military installations, communications networks, financial institutions, transportation systems, data centers, and emergency services all depend upon reliable electricity. A prolonged regional blackout wouldn’t simply leave families fumbling for candles. It could interrupt medical care, disable water and sewage systems, disrupt food and fuel distribution, impair military readiness, and cause economic damage that spreads far beyond the original outage.

That makes the grid an extremely attractive target for hostile governments. The threat isn’t speculative in the sense of being invented yesterday for an executive-order signing ceremony. In 2024, the Cybersecurity and Infrastructure Security Agency and several international partners warned that the Chinese state-sponsored group known as Volt Typhoon had compromised American critical infrastructure and was attempting to position itself for potentially disruptive cyberattacks during a future crisis or conflict. Its targets included organizations in the energy, communications, transportation, and water sectors.

The concern isn’t limited to hackers trying to guess passwords from a basement in Beijing. Modern grid equipment may contain firmware, digital controls, communications modules, cloud connections, maintenance software, and remote-access capabilities. A component can perform perfectly during ordinary operation while still containing an undocumented pathway that becomes useful to a foreign intelligence service later.

Experts examining some Chinese-manufactured solar-power inverters discovered previously undocumented communications equipment, intensifying concerns that remotely accessible grid technology might contain capabilities unknown to its owners. That doesn’t establish that every Chinese inverter is a digital Trojan horse, but it does demonstrate why “the equipment turned on when we installed it” isn’t a complete cybersecurity audit.

Supporters also argue that supply dependence creates a second vulnerability even when no malicious code is present. If the United States relies heavily upon an adversarial country for transformers, inverters, control systems, replacement components, or specialized materials, that country gains leverage during a diplomatic confrontation, trade dispute, or military conflict. It doesn’t need to hack the grid if it can simply stop shipping the equipment needed to repair or expand it.

The Department of Energy has acknowledged that critical grid components already face serious supply-chain problems, including dependence on imported parts, limited domestic manufacturing, and long production times. Some vital equipment now requires two years or more to obtain. Those same conditions that make restrictions expensive also demonstrate why permanent foreign dependence carries its own price.

Supporters further point out that the order is more carefully structured than the phrase “foreign-equipment ban” suggests. It doesn’t automatically prohibit every imported product. Before blocking a transaction, the Energy Department must connect the equipment to a covered foreign entity and determine that it presents an undue or unacceptable security risk. Officials may impose security conditions instead of prohibiting a transaction, establish prequalified vendors, license otherwise restricted transactions, and phase in replacement requirements when immediate action could threaten reliability.

The legal basis may also be stronger than Trump’s previous reliance on the International Emergency Economic Powers Act to impose tariffs. In February, the Supreme Court held that IEEPA doesn’t authorize presidential tariffs. At the same time, the Court emphasized that the statute expressly allows the president to “prevent or prohibit” importation during a qualifying emergency. Because this order blocks or conditions dangerous transactions rather than imposing a tax on them, supporters can argue that it rests much closer to the powers Congress actually placed in the statute.

Finally, supporters see the order as an opportunity to rebuild American industrial capacity. Producing more transformers, control systems, high-voltage equipment, and grid electronics domestically would reduce strategic dependence while creating skilled manufacturing jobs. National security procurement has helped sustain American industries before. The electric grid isn’t an unreasonable place to decide that the cheapest available bidder shouldn’t automatically win, especially when the bidder answers to a government that regards cyberwarfare as a perfectly respectable activity.

The Case Against an Emergency Label with a Utility Bill Attached

Opponents don’t necessarily deny that foreign adversaries threaten the grid. Their first objection is that recognizing a genuine problem doesn’t automatically validate every power claimed in response to it.

“National emergency” has become one of Washington’s favorite phrases. Presidents of both parties have used emergency declarations to move faster, bypass ordinary political resistance, and exercise powers that Congress might otherwise debate more carefully. Critics worry that the country is gradually normalizing government by emergency proclamation: announce an extraordinary threat, delegate broad discretion to an executive agency, and promise to provide the important definitions later.

That concern is particularly relevant because the order leaves crucial decisions to the Energy Department. It covers an extensive range of equipment, software, firmware, maintenance services, digital services, and remote-access capabilities. It also allows executive officials to determine which additional governments or entities qualify as covered foreign threats.

The administration may possess classified evidence that can’t be released publicly, but the order itself identifies no particular compromised product, vendor, or government. Critics can reasonably ask for clearer standards showing how officials will distinguish a verified security threat from an ordinary foreign product that happens to compete with an American manufacturer. National security shouldn’t become a magic phrase that turns protectionism into cybersecurity by simply changing the label on the folder.

Cost is another serious objection. Grid equipment isn’t sitting in abundance at the local hardware store between extension cords and smoke detectors. The United States already faces transformer shortages, limited domestic capacity, escalating prices, and lead times of two years or more. The Energy Department says some transformer prices have increased four- to ninefold in five years. Removing existing equipment or excluding major suppliers before dependable alternatives are available could delay new generation, grid modernization, battery projects, manufacturing facilities, and data-center connections.

Those costs won’t vanish because the White House calls them national-security investments. Utilities will seek to recover them, usually through higher rates, government assistance, or both. The order doesn’t establish a clear funding mechanism for replacing installed equipment. A large utility may be able to absorb a phased replacement program, but smaller operators and public-power systems could struggle with it. Eventually, the bill is likely to arrive in somebody’s mailbox, wearing the familiar disguise of “just a few dollars more per month.”

Opponents also argue that a manufacturer’s national origin is an imperfect measure of security. Modern equipment frequently contains components, software, materials, and subassemblies sourced from several countries. A product assembled in America can contain vulnerable foreign code, while equipment manufactured by a trusted company abroad may be thoroughly tested and secure.

Real cybersecurity requires technical standards, software verification, access controls, network segmentation, continuous monitoring, vulnerability reporting, secure update procedures, and careful management of vendors throughout the equipment’s life. Replacing a foreign nameplate with an American flag sticker doesn’t automatically remove insecure code. Security theater is still theater, even when the stage lights are connected to a domestically manufactured transformer.

Critics further contend that the federal government already has mechanisms for addressing these risks. The Federal Energy Regulatory Commission and the North American Electric Reliability Corporation enforce mandatory Critical Infrastructure Protection standards, including supply-chain risk-management requirements for important bulk-electric cyber systems. FERC and DOE have also examined vendor accreditation, product testing, supply-chain transparency, embedded spyware, and security gaps through technical conferences and industry partnerships.

The existence of those programs doesn’t prove that they’re sufficient. It does, however, place a burden on the administration to explain what existing rules failed to accomplish and how the new emergency authority will close the gap without producing redundant mandates or conflicting requirements.

There’s also the problem of policy whiplash. Trump issued a similar order in 2020. Biden suspended it in 2021, and the Energy Department revoked the associated prohibition while developing a different approach. Trump has now restored and expanded the concept. Utilities make investments intended to last decades, not merely until the next inauguration. If grid-security policy changes substantially whenever the Oval Office changes occupants, companies can’t plan procurement, replacement schedules, or long-term capital projects with confidence.

Opponents therefore prefer congressional legislation establishing durable standards, defined threat criteria, funding priorities, judicial safeguards, and a stable division of responsibility among DOE, FERC, NERC, utilities, and intelligence agencies. An executive order can move quickly, but speed isn’t the same thing as permanence, and transformers tend to have a longer life expectancy than presidential directives.

Build the Firewall, but Don’t Hand Over a Blank Check

From my perspective, Trump is right about the central danger and broadly justified in treating it seriously.

America shouldn’t knowingly place the backbone of its electric grid in the hands of companies controlled by hostile governments. Free enterprise doesn’t require strategic stupidity. There’s nothing conservative about becoming dependent upon an adversary for equipment that powers military bases, hospitals, water systems, communications networks, and nearly every productive sector of the economy.

The government has a legitimate responsibility to protect innocent people from credible foreign threats. Scripture praises prudent preparation: “A prudent man foreseeth the evil, and hideth himself; but the simple pass on, and are punished” (Proverbs 27:12). Waiting until a hostile government activates a backdoor or cuts off replacement equipment wouldn’t be restraint. It would be negligence.

The order is also meaningfully narrower than some headlines imply. It requires a connection to a covered foreign entity, an official risk determination, and consideration of reliability before existing equipment is disconnected or removed. It allows mitigation, licensing, prequalified vendors, and phased compliance. Those are sensible provisions, not the workings of an indiscriminate “ban everything foreign” machine.

Still, the emergency declaration must be treated as a bridge to durable policy, not as a permanent substitute for Congress.

The administration should publish specific, technically defensible criteria for identifying dangerous equipment and vendors. Restrictions should focus on adversarial control, unverifiable software, hidden communications functions, remote-access vulnerabilities, and genuine supply-chain leverage, not merely the word “foreign.” Trusted allies shouldn’t be casually lumped together with hostile regimes, and secure foreign equipment should remain available when domestic capacity can’t meet immediate reliability needs.

Replacement orders should be phased according to actual risk. Equipment presenting an active remote-access vulnerability deserves faster action than a transformer that contains no networked controls and has operated securely for years. Ratepayers, municipal utilities, and rural cooperatives shouldn’t be handed enormous unfunded replacement mandates because Washington spent decades ignoring the same industrial weakness that it’s now discovered constitutes an emergency.

The United States must also expand domestic production before closing off essential supplies. That means faster permitting, predictable regulations, workforce development, material availability, standardized equipment designs, and partnerships with reliable allies. “Buy American” works much better when America is prepared to manufacture what everyone has been ordered to buy.

Most importantly, Congress should convert the strongest parts of this order into legislation. Lawmakers should define covered adversaries, establish testing and certification requirements, require regular threat assessments, provide transparent oversight, create reasonable cost-recovery mechanisms, and include periodic review or sunset provisions. Grid security shouldn’t be switched on and off whenever a new administration arrives with a different collection of executive orders and a fresh box of ceremonial pens.

My verdict, then, is support with firm guardrails.

Trump’s correct that adversary-controlled equipment, opaque software, and foreign supply dependence can create unacceptable risks in the bulk-power system. The government should block verified threats and replace dangerous equipment before a foreign government gets the opportunity to use it. But the policy must remain evidence-based, targeted, reviewable, and connected to a realistic domestic manufacturing strategy.

Electricity is too important to entrust to foreign backdoors. Constitutional accountability is too important to entrust to a forever emergency. Secure the grid, publish the standards, build more equipment at home, protect ratepayers, and make Congress do its job.

That should keep both the lights and the Constitution switched on.
